Getting Familiar With Work Visas

About Me
Don't Worry, It's The Law

Thanks for stopping by my website focused on law. My name is Luke Donahue and I absolutely love law and order. I wish that there was a greater respect for law in our society. When we understand what is expected of us and what is allowed, it is much easier to make decisions and live a fulfilling life. I feel that some do not respect the law because they simply do not understand it. Therefore, I have decided to create a website that covers various legal topics of interest to me and I will try to explain these topics from a layman's perspective.

If you are interested in traveling to another country, then you will usually need to get a visa. To help you get a better idea of how the process of getting a visa works, here is an overview of one specific type: the work visa.

The Work Visa

If you are planning on working in a foreign country, then you will usually need a work visa. There are many different types of work visas, since there are so many different categories that you work might fall into. For example, when going to work in the United States, you might apply for an H-1B, H-2A, H-2B, H-3, L, or any number of other visas.

  • H-1B visas are used for specialty workers, often working on research projects that involve multiple countries.

  • H-2A visas are for individuals that work in seasonal agricultural work. Since many elements of agriculture are highly dependent upon the current climate, and because the length of such seasons can be accurately predicted, these visas are often very specific in the number of months that they are effective.

  • H-2B visas are for individuals that have seasonal work that is unrelated to agriculture.

  • H-3 visas are used for work training programs and opportunities in the United States.

  • L visas are commonly used for managers that have been transferred to a branch of their company that is in another country.

One similarity between many of the types of work visas is that they are issued for set periods of time. For seasonal work, this period might be as short as a few months, while it could be for several years if you have an L visa.

Getting a Work Visa

To actually get a work visa, you are usually going to need your company to file for the visa on your behalf. Once they have initiated the process, you will be responsible for filling out several documents, scheduling an interview at an embassy, paying some fees, and attending the interview. As long as you have the proper documentation (such as a passport and proof of identification) and have a valid reason for the visa, there is a good chance that it will be granted.

Once you have the visa, then you will be able to travel to the country in question. However, you need to be careful about how long you stay. While you can request an extension of your visa, you should do so long before your visa expires. If you are still in the country when your visa expires, you will need to leave immediately or you might be in some trouble.
